How to Fight a Stop Sign Ticket
Section 136(1) of the Highway Traffic Act, RSO 1990, c H.8 states: “Every driver or street car operator approaching a stop sign at an intersection, (a) shall stop his or her vehicle or street car at a marked stop line or, if none, then immediately before entering the nearest crosswalk or, if none, then immediately before entering the intersection; and (b) shall yield the right of way to traffic in the intersection or approaching the intersection on another highway so closely that to proceed would constitute an immediate hazard and, having so yielded the right of way, may proceed.”
Ticket Shield is able to defend you against Disobey Stop Sign charges anywhere in Ontario. This is one of the most common charges issued under the Highway Traffic Act. One of the biggest misconceptions is that the driver must stop at the physical location of the sign. As can be seen above, the actual location of the sign does not matter. The stop lines or crosswalk lines determine where you are required to stop your vehicle.
Even if the way is clear to proceed, you are still required to come to a full and complete stop to comply with this law.
Penalty:
- Set Fine: $85.00
- Demerit Points: 3
- Additional Penalties: A conviction on your driving record for 3 years
Should I Fight the Disobey Stop Sign Charge?
Most definitely. Disobey Stop Sign is a 3 demerit point offence. Not only can this affect your insurance premiums, if you accumulate enough demerit points, you could face suspension or lose your license completely.
How will Ticket Shield help you fight your Disobey Stop Sign Charge?
Ticket Shield spends the necessary time on your case with the purpose of eliminating the charges completely by having them withdrawn or dismissed. If this is not possible, we will negotiate with the prosecutors to shield your demerit points, protect your license from being suspended, negotiate for the lowest fine available, and ultimately, keep your insurance rates as low as possible.
Ticket Shield begins preparing your defence with requesting a disclosure pack from the prosecutors. We make a very specific request that requires them to provide the Police Officer’s notes, witness reports, radar manuals and calibration notes (if applicable), and any other relevant evidence that they plan to use against you. By obtaining these documents prior to your court date, we can review them with you if we have any questions, and prepare a defence based on all of the information.
