OFFENCES FOR G1 AND G2 LICENSE HOLDERS
G1 and G2 drivers are subject to additional restrictions in the operation of motor vehicles. For example, they must have zero alcohol in their system at all times while driving. In August, 2010, Ontario introduced Novice Driver Escalating Sanctions regulations. This includes a licence suspension if you are convicted of a Drive – Handheld Device offences (Cell Phone). Any conviction that carries 4 or more demerit points, or violating any of the graduated licensing conditions, will result in a suspension of their license for at least 30 days. The suspension will be increased to 90 days for a second violation. If the graduated licensing conditions are violated 3 times, your licence will be cancelled and you will need to reapply for your G1 again.
There are also point limit restrictions. If you accumulate 6 demerit points with a Notice Licence, you will be called in to the MTO for an interview to discuss a potential licence suspension. The first accumulation of 9 or more demerit points will result in a 60 day suspension. For any subsequent suspensions of the novice driver, the suspension time is increased.
Should I Fight the Charge?
Convictions for novice drivers will often result in very large increases in insurance premiums, and in some cases, can be very difficult to find an insurance company willing to offer coverage.
How will Ticket Shield help you fight your charge?
Ticket Shield spends the necessary time on your case with the purpose of eliminating the charges completely by having them withdrawn or dismissed. If this is not possible, we will negotiate with the prosecutors to shield your demerit points, protect your license from being suspended, negotiate for the lowest fine available, and ultimately, keep your insurance rates as low as possible.
Ticket Shield begins preparing your defence with requesting a disclosure pack from the prosecutors. We make a very specific request that requires them to provide the Police Officer’s notes, witness reports, radar manuals and calibration notes (if applicable), and any other relevant evidence that they plan to use against you. By obtaining these documents prior to your court date, we can review them with you if we have any questions, and prepare a defence based on all of the information.
